Welcome to the Sound Yeti website (the “Site”). By using our Site and purchasing products or services from Sound Yeti (“SY,” “we,” “us”), you agree to comply with and be bound by these Terms of Service (the “Agreement”). If you do not agree, do not use the Site or purchase products from us.

1. Acceptance of Agreement

This Agreement constitutes the agreement between you and Sound Yeti with respect to the Site and purchases made through the Site. We may update this Agreement by posting a revised version on the Site. Continued use after changes constitutes acceptance.

2. Intellectual Property; Limited License to Users

Materials and services on this Site are protected by intellectual property laws. Except as expressly provided, Sound Yeti does not grant rights to copy, republish, frame, download, transmit, modify, rent, lease, loan, sell, assign, distribute, license, sublicense, reverse engineer, or create derivative works based on the Site except as authorized herein. You agree not to use data mining, robots, or similar extraction methods in connection with the Site.

3. Copyright and Trademarks

Site content, organization, graphics, design, audio, and related materials are protected. You do not acquire ownership rights to materials viewed through the Site. Sound Yeti™ and related marks are trademarks of Sound Yeti. Native Instruments and other third-party marks are property of their respective owners.

4. Use of Software and Content Products

Software, Kontakt instruments, sound libraries, and other digital products made available from this Site are licensed, not sold. Use is governed by the applicable End User License Agreement presented at purchase or accompanying the product (Sound Library EULA and/or Software EULA). You will not be able to download or use products accompanied by a license agreement unless you agree to those terms. Absent a specific product EULA, use is also governed by this Agreement. You agree not to decompile, reverse engineer, or attempt to discover source code of software available on the Site except where mandatory law permits.

5. Limited Right to Use Site Materials

Viewing, printing, or downloading content from the Site grants only a limited, non-exclusive license for your personal use and not for republication, distribution, assignment, sublicense, sale, or preparation of derivative works. Sound Yeti may revoke authorization at any time.

6. Editing, Deleting and Modification

We reserve the right to edit or delete any documents, information, or other content appearing on the Site.

7. Indemnification

You agree to indemnify, defend, and hold Sound Yeti and its partners, staff, and affiliates harmless from liability, loss, claim, and expense (including reasonable attorneys’ fees) related to your violation of this Agreement or use of the Site.

8. Nontransferable

Your right to use the Site is not transferable. Passwords and account access rights are not transferable.

9. Disclaimer and Limits (As Is)

THE SITE AND INFORMATION FROM OR THROUGH THE SITE ARE PROVIDED “AS-IS,” “AS AVAILABLE,” AND ALL WARRANTIES, EXPRESS OR IMPLIED, ARE DISCLAIMED (INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE). WE HAVE NO LIABILITY WHATSOEVER FOR YOUR USE OF ANY INFORMATION OR SERVICE EXCEPT AS REQUIRED BY LAW. IN PARTICULAR, WE ARE NOT LIABLE FOR INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR MAXIMUM LIABILITY TO YOU UNDER ALL CIRCUMSTANCES WILL BE EQUAL TO THE PURCHASE PRICE YOU PAID FOR THE APPLICABLE GOODS OR SERVICES GIVING RISE TO THE CLAIM.

We may use information regarding Site use and information you provide in accordance with our Privacy Policy. The Site uses cookies as described in our Cookie Policy and Privacy Policy.

11. Third-Party Services and Links

The Site may link to or integrate third-party services. We do not control third-party sites or services and are not responsible for their content, policies, or transactions. Use of third parties is at your own risk.

Our Privacy Policy is part of this Agreement.

13. Payments

You represent that payment information you supply is true and complete, that charges will be honored by your payment provider, and that you will pay charges incurred at posted prices including applicable taxes.

14. Product Licenses and Delivery

Digital products are delivered electronically. License rights are as stated in the applicable EULA and on your purchase receipt. Order license certificates may be issued for qualifying purchases and made available in your account.

15. Returns

Returns and refunds are governed by our Return Policy.

16. Governing Law

This Agreement shall be governed by the laws of the United States applicable therein. You submit to the non-exclusive jurisdiction of the courts of the United States. If any provision is unenforceable, the remaining provisions remain in effect.
